1、 The tender documents shall specify the period of validity of the tender. That is, the tenderee must stipulate the time limit for commitment to the tenderer when issuing the bidding documents. Due to the rapid changes in the drug market, if the tenderee's commitment can not be made, it will greatly increase the business risk of the bidder. In the pilot stage of centralized bidding procurement, it is quite common for the tenderee to fail to issue the letter of acceptance three, five months or even longer after the bid opening. In order to protect the interests of the tenderer, the tenderee must specify the period of validity of the tender in the tender document.
2、 The period of validity of a bid is calculated from the deadline for submission of bids, which should not exceed 90 days in general. Generally, the validity period of a centralized bidding procurement project does not need 90 days. If the tenderee adopts a more mature e-commerce mode, there is no difficulty to complete the bid evaluation, determine the bid, issue the bid winning notice and sign the drug purchase and sale contract with the bidder within 30 days. In the work specification, the period of validity of the bid is generally not more than 90 days, because the manual operation method is used for comprehensive evaluation, which requires a lot of time to complete the bid evaluation and determination. In addition to the impact of unforeseen events, it is necessary to stipulate that the bid validity period should not exceed 90 days in general.
3、 Bid evaluation and award shall be completed 30 days before the expiration of the bid validity period. If the bid evaluation and award cannot be completed 30 days before the expiration of the bid validity period, the tenderee shall notify all bidders to extend the bid validity period. The tenderee shall compensate the tenderer for the loss caused by the extension of the validity period of the tender, except for the extension of the validity period of the tender due to force majeure. This provision is made in the work specification because Article 54 of the work specification stipulates that the tenderee and the tenderer shall sign the drug purchase and sale contract within 30 days after the issuance of the letter of acceptance. If the tenderee entrusts the bidding agency to sign the drug purchase and sale contract, or organizes a drug purchase and sale contract signing conference to gather all the tenderee and bidders to sign the drug purchase and sale contract, the time required for signing the drug purchase and sale contract will be greatly shortened.
Although the tenderee cannot complete the bid evaluation and determination 30 days before the expiration of the bid validity period, as long as it can complete the signing of the drug purchase and sale contract before the expiration of the bid validity period, it is not necessary to extend the validity period of the bid and bear any legal liabilities arising therefrom. Extension of the validity period of the bid is likely to cause loss to the bidder, which needs to be compensated by the tenderee. Therefore, the tenderee should be very careful about whether to extend the validity of the tender. Although the bid evaluation and determination cannot be completed 30 days before the expiration of the bid validity period, if the time can be reasonably used to sign the drug purchase and sale contract with the bidder before the expiration of the bid validity period, the tenderee does not have to extend the bid validity period.
