议标也称谈判招标或限制性招标,即经过谈判来肯定中标者。

“比价”是兼有约请招标和协商特性的一种招标方式,普通运用于范围不大、内容简单的工程和货物采购。通常的作法是由招标人将采购的有关恳求送交选定的几家企业,恳求他们在商定的时间提出报价,招标单位经过火析比较,选择报价合理的企业,就工期、造价、质量付款条件等细节中止协商,从而达成协议,签署合同;

它是选择工程规划设计任务的常用方式。通常组织公开,也可约请经预先选择的规划设计机构参与竞赛。普通的作法是由招标人提出规划设计的基本恳求和投资控制数额,并提供可行性研讨报告或设计任务书、场地平面图、有关场地条件和环境情况的说明,以及规划、设计管理部门的有关规则等基础资料,参与竞争的单位据此提出自己的规划或设计的初步方案,阐述方案的优点和优点,并提出该项规划或设计任务的主要人员配置、完成任务的时间和进度布置、总投资预算和设计等,一并报送招标人。然后由招标人约请有关专家组成的评选委员会,选出优胜单位,招标人与优胜者签署合同。对未中选的参审单位给以一定补偿。

另外在科技招标中,通常运用公开招标、但不公开开标的议标。招标单位在接到各招标单位的标书后,先就技术、设计、加工、资信才干等方面中止调整,并取得初步认可的基础上,选择一名理想的预中标单位并与之商谈,对标书中止调整协商,如能取得分歧意见,则可定为中标单位,若不行则再找第二家预中标单位。这样逐次协商,直到双方达成分歧意见为止。这种议标方式使招标单位有更多的灵活性,可以选择到比较理想的供应商和承包商。

由于议标的中标者是经过谈判产生的,不便于公众监视,容易招致非法买卖,因此,我国机电设备招标规则中,遏止采用这种方式。即使允许采用议标方式,也大都对议标方式做了严厉限制。

《分离国贸易法委员会货物、工程和效劳采购示范法》规则:经发布国批准,招标人在下述情况下可采用议标的方法中止采购:
Rules of the UNCITRAL Model Law on Procurement of Goods, Construction and Services in Separate Countries: With the approval of the issuing State, the tenderer may suspend procurement by negotiating tenders in the following circumstances:
1、急需获得该货物、工程或效劳,采用招标程序不真实际,但条件是构成此种紧迫性的情况并非采购实体所能预见,也非采购实体办事拖拉所致;
1. It is urgent to obtain the goods, works or services. It is unrealistic to adopt the tendering procedure, provided that the situation constituting such urgency is not foreseeable by the procuring entity, nor is it caused by the procuring entity's procrastination;
2、由于某一灾难性事情,急需得到该货物、工程或效劳,而采用其它方式因耗时太多而不可行。
2. Because of a catastrophic event, the goods, projects or services are urgently needed, while other methods are not feasible because of the time-consuming.
